Steinberg, Goodman & Kalish recently secured a new trial opportunity for our client in a wrongful death lawsuit against a northwest suburban hospital and the maker of the Da Vinci surgical system.  Our client filed the wrongful death lawsuit after his wife died of cervical cancer following a robotic laparoscopic hysterectomy performed using the Da Vinci robot.  Unfortunately, his former counsel failed to appear for a court hearing and the case was dismissed on a technicality.

When our client came to us, we knew we had to help him fight this dismissal so she could seek justice for his late wife. We took over the case and argued that fairness required that our client be given his day in court and that he should not be penalized for the misconduct of his lawyer—nor should defendants be permitted to avoid legal liability.  Fortunately, the appellate court agreed and reversed the dismissal.  Our client can now pursue the wrongful death case against the responsible parties.
