When Medical Malpractice Happens Outside the Hospital

When a person thinks of medical malpractice, he or she typically thinks of a patient in a hospital who does not receive the medical care that he or she needs - whether it is obstetrical negligence during a birth or surgical malpractice during a medical procedure or the failure to properly treat during an emergency.

  • Diagnostic Errors. Misdiagnosis is the most common type of medical error, with an estimated 10 to 20 percent of medical malpractice cases involved a diagnostic error. Often times, a patient will see his or her doctor for a general office visit to discuss symptoms. When the doctor fails to properly diagnose the patient, serious injuries and medical complications can result. In fact, according to a 2009 report, 28 percent of 583 diagnostic mistakes reported anonymously by doctors were life-threatening or had resulted in death or permanent disability.

  • Medication errors. If a doctor fails to prescribe the correct drug or dosage, or a pharmacist incorrectly fills a prescription, the patient may suffer from an adverse drug reaction, which can range from mild to severe and even deadly.
