What to Do If Your Child Suffers a Birth Injury

A birth injury is every parent's worst nightmare. While birth injuries can occur through the fault of no one, in some cases, birth injuries are the result of medical malpractice. Since this is an especially trying and stressful time, there are several things to remember if your child has suffered a birth injury.

  1. Determine whether your child suffered a birth injury and, if so, the extent of the injury. In some cases, a birth injury is not immediately apparent and isn't diagnosed until further medical testing is done. There are several factors that can indicate whether your child may have suffered a birth injury, such as an extended labor and/or delivery, a breech delivery, an unexpected C-Section, use of vacuum extractor or forceps, or low fetal heart rate during delivery. If any of these factors were present in your child's birth, you may wish to seek additional medical testing for a possible birth injury.

  2. Get the appropriate medical care for your child. In some cases, that means switching doctors or getting a second opinion. Your child's health and wellbeing are the most important and you should do whatever you can to mitigate the long-term effects of your baby's birth injury.

  3. Contact a knowledgeable medical malpractice attorney. At Steinberg, Goodman & Kalish, our Chicago birth injury attorneys focus on helping families deal with the legal and financial aftermath of a birth injury.

  4. Obtain and save all pertinent medical records, including documentation related to prenatal care, childbirth, and post-delivery care.

  5. Avoid dealing with insurance or health care providers without the advice of a medical malpractice attorney. Insurance companies sometimes make settlement offers, but these are often much less that the amount to which you may be entitled. Avoid signing any settlement offers without consulting an experience birth injury lawyer.
